[ARCHIVED] MDMA, Firearms Charges Among Those Settled in Wayne County Court

HONESDALE -- Wayne County District Attorney A.G. Howell announced the following sentences were handed down by President Judge Janine Edwards on Thursday, May 26:

JOHN MATTHEW BARNES, age 43 of Springville Pa, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 15 months nor more than 48 months for one count of Delivery of a Controlled Substance – MDMA (F). He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, and obtain employment within 30 days of parole or provide documentation from a doctor precluding him from employment. The incident occurred on September 3, 2021 in Buckingham Township.

BETH CIERKOWSKI, age 43 of Scranton Pa, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 2 months nor more than 12 months for one count of Possession of Drug Paraphernalia (M), one count Required Financial Responsibility (S), and one count of Driving While Operating Privilege Suspended/Revoked (S). She was also ordered to pay the costs of prosecution, pay a fine in of $500.00, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, and obtain employment within 60 days of parole or provide documentation from a doctor precluding her from employment. The incident occurred on November 3, 2021 in Lebanon Township.

MELISSA MARIE CONOVER, age 53 of Pleasant Mount Pa, was placed on the Accelerated Rehabilitation Disposition Program for a period of 6 months related to a DUI. She was also ordered to pay all costs, complete 20 hours of community service, complete the Alcohol Highway Safety Program, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, and have his operator’s license suspended for a period of 30 days. The incident occurred on December 1, 2021 in Honesdale Borough.

ANTHONY MICHAEL DESANTIS, age 59 of Honesdale Pa, previously sentenced on June 3, 2021 to 18 days to 23 ½ months in the Wayne County Correctional Facility related to Simple Assault, was resentenced to undergo incarceration in the Wayne County Correctional Facility for the remainder of his sentence, which is May 1, 2023. He was also ordered to undergo a drug and alcohol re-evaluation and comply with any recommendations for treatment, attend and complete another anger management course, and attend outpatient therapy for mental health. The Defendant was found in violation of his probation when he violated several conditions including using illegal controlled substances, and tested positive for illegal controlled substances.

ERIC LEWIS DUNN, age 41 of Beach Lake Pa, was sentenced to 12 months probation for one count of Possession of Controlled Substance – Marijuana (M), and one count Possession of Drug Paraphernalia (M). He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, undergo a mental health evaluation and comply with any recommendations for treatment, and obtain employment within 60 days of sentencing or provide documentation from a doctor precluding him from employment. The incident occurred on August 7, 2021 in Texas Township.

ALEX CAIN FRINDT, age 22 of Hawley Pa, was placed on the Accelerated Rehabilitation Disposition Program for a period of 6 months related to a DUI. He was also ordered to pay all costs, complete 20 hours of community service, complete the Alcohol Highway Safety Program, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, and have his operator’s license suspended for a period of 60 days. The incident occurred on April 28, 2021 in Hawley Borough.

JULIAN GERARD HYLAND, age 31 of Honesdale Pa, previously resentenced on January 6, 2022 to incarceration at the Wayne County Correctional Facility and re-paroled on March 10, 2022 related to Simple Assault, was resentenced to undergo incarceration at the Wayne County Correctional Facility for the remainder of his sentence which is August 22, 2022. The defendant was found in violation of his probation when he was arrested on April 13, 2022 on new charges.

PHILIP MICHAEL LYNOTT, age 23 of Gouldsboro Pa, was sentenced to undergo incarceration in a State Correctional Facility for a period of not less than 16 months nor more than 60 months for one count of Persons Not to Possess, use, Firearms (M1), and one count recklessly Endangering Another Person (M2). He was also ordered to pay the costs of prosecution. The incident occurred on January 28, 2022 in Lehigh Township.

JOHN V. McDONALD, age 47 of Madison Township Pa, previously sentenced on August 26, 2021 to undergo incarceration in the Wayne County Correctional Facility to 15 days to 60 months related to Theft, was resentenced to undergo incarceration in the Wayne County Correctional Facility for the remainder of his sentence, which is August 25, 2026. The Defendant was found in violation of Probation when failed to report to the probation department as instructed, and failed to make restitution payments.

DEBRA MARIE OWENS, age 44 of Browndale Pa, previously sentenced on February 17, 2022 to 77 days to 12 months in the Wayne County Correctional Facility related to Criminal Trespass, was resentenced to undergo incarceration in the Wayne County Correctional Facility for the remainder of her sentence, which is December 2, 2022. The Defendant was found in violation of her probation when he violated multiple conditions including failing to report to probation, leaving her approved residence without prior approval, and being at the victim’s residence she was ordered to stay away from. 

KELLY M. POTTS, age 36 of Newfoundland Pa, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 3 months nor more than 23 ½ months for three (3) counts Possession of Controlled Substance (M), and one count Possession of Drug Paraphernalia (M). She was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, and obtain employment within 60 days of parole or provide documentation from a doctor precluding her from employment. The incident occurred on August 23, 2021 in Lake Township.

FRANCISCO RICHARD RODRIGUEZ, age 29 of Starlight Pa, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 3 months nor more than 30 months for one count of Possession of Controlled Substance with Intent to Deliver – Marijuana (F). He was also ordered to pay the costs of prosecution, pay restitution in the amount of $143.57, continue with drug and alcohol treatment and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, and obtain employment within 30 days of parole or provide documentation  from a doctor precluding him from employment. The incident occurred on November 21, 2021 in Preston Township.

EDMUND CASTERLINE, age 56 of Effort Pa, was issued a Bench Warrant for failure to appear at court.
