[ARCHIVED] DA Files Charges Against Wayne County Prison Inmate

Wayne County District Attorney A.G. Howell announced the arrest of Timothy Everard, age 33, of Damascus, for multiple incidents of criminal behavior that occurred inside the Wayne County Correctional Facility.  Everard is accused of assaulting another inmate, vandalizing the facility and causing injury to a Corrections Officer as well as causing the jail to go into lock down on three separate occasions.  

The first criminal complaint was filed by Wayne County Detective Michael McMorrow based on an incident that occurred on September 15, 2020 when Everard assaulted another inmate. When corrections officers found out about the assault on September 21, 2020 and attempted to place Everard into the restricted housing unit, he aggressively pulled away from the officers and injured one of the officers. For these incidents, Everard was charged with one count of Simple Assault, a misdemeanor 2nd degree, one count of Harassment, a summary, and one count of Disorderly Conduct, a summary.

The second criminal complaint was filed by Wayne County Detective Michael McMorrow based on an incident that occurred on September 21, 2020 when Everard clogged his cell toilet and flushed it repeatedly, causing his cell to flood. After the water was cleaned up, Everard damaged the sprinkler head in his cell, causing the entire unit to flood and causing the fire alarm in the facility to activate. For these incidents, Everard was charged with two counts of Institutional Vandalism, both misdemeanor 2nd degree, one count of Injuring or Tampering with Fire Apparatus, a misdemeanor 3rd degree, one count of Disorderly Conduct, a misdemeanor 3rd degree, and one count of Criminal Mischief, a summary.

The third criminal complaint was filed by Wayne County Detective Michael McMorrow based on an incident that occurred on September 29, 2020 when Everard punched out the window in his cell and then ripped a handicap bar off the wall. For these incidents, Everard was charged with two counts of Institutional Vandalism, both misdemeanor 2nd degree and one count of Disorderly Conduct, a misdemeanor 3rd degree.

In total, Everard caused a total of over $500.00 in damages to the facility.

 On October 5, 2020, Everard was arraigned by Magisterial District Judge Myers on all three complaints and will continue to be remanded at the Wayne County Correctional Facility where he has been since his last arrest.  His Central Court date for the new charges is set for October 14, 2020.
